Common Question – Who will have custody of the children while my divorce is pending?
Massachusetts General Law 208 § 19 allows the Court to order custody of a child during a pending case on Motion of either party. This is done by either party filing a Motion for Temporary Orders, very often at the time as or just after the filing of the petition for divorce.
Every case is different, custody could be joint, sole, or one party with primary custody and the other with visitation.
