The Different Types of Custody in Massachusetts
There are several options for child custody, but there are 4 main types that are recognized by the Probate and Family Court in Massachusetts. They are sole legal custody, shared legal custody, sole physical custody, and shared physical custody.
- Sole Legal Custody - means one parent makes all of the decisions for the child such as education, medical issues, religion, and all other decisions critical to the child's well being.
- Shared Legal Custody- Both parents share legal custody, and both make the decisions. The child usually stays with one parent part of the year, and the other for the rest of the year.
- Sole Physical Custody - means the child lives with one parent while the other parent gets reasonable visitation, but no say in major decisions concerning the child.
- Shared Physical Custody - is the favored agreement because it allows both parents to have an equal say in raising the child. Both parents are willing and able to share in the responsibilities, and they can have an amicable relationship with each other. Both parents usually have similar lifestyles and no drug or alcohol abuse or domestic violence.
